Abstract

The major and significant problem facing this study is: Are there contemporary approaches in the fundamentals of Jurisprudence that could contribute to effective solutions for contemporary issues in the science of jurisprudence, and, if so, what is the extent of their impact on the process of jurisprudential deduction and its implications.
The significance of the topic arises from the fact that the Islamic legal rulings based on words or others, whether by means of direct reference, or by means of pointing gesture, are able to find new jurisprudential solutions that are compatible with the requirements of the current era. This can only be possible through the development of new approaches in the science of jurisprudence.
There are grounds for choosing this subject, which can be summarized as follows:
1 – The scientific and practical value of the current topic, among other topics explored in the science of jurisprudence.
2- nrich the Islamic library in general, and the fundamentals of jurisprudence library in particular, in specialized studies in the field of jurisprudence, and aligned them to other jurisprudential branches as much as possible.
The current study comprises of an introduction, preface and five chapters, and ends with a conclusion of the key findings, in addition to a list of sources and references, and finally an English abstract.
