The doctoral thesis titled “Foundations of State Jurisprudence in Imamiyyah: Presentation and Analysis” by the student Abbas Abdul Amir Mohammed Sadiq Al-Shibani was discussed at the College of Islamic Sciences at the University of Karbala. The defense took place in the Imam Hussein (peace be upon him) hall within the college.
The researcher delved into the jurisprudential foundations of Imamiyyah scholars regarding the jurisprudence of the state, presenting their opinions and evidence regarding the governance of the jurisprudent (Islamic jurist) and the limits of his authority. This exploration encompassed historical aspects of the formation of the Islamic state, its developmental stages, and an elucidation of the prominent theories of Imamiyyah scholars regarding the establishment of the state, governance system, and the principles upon which it is built. Additionally, the researcher highlighted the key jurisprudential rules related to political jurisprudence and the system of governance.
Through the study and analysis of these theories, the researcher proposed a new theory alongside existing ones, naming it “Khilafat al-Ummah, Shura of the Authorities, and their Supervision.” The researcher compared his new theory with previous ones, asserting that his theory emerged as a result of understanding and agreement with those theories in certain aspects.
The researcher believes that his new theory is closer to reality and more applicable than other aforementioned theories, aligning with the current stage’s requirements and challenges.
The examination committee comprised Professor Dr. Dhargham Kareem Al-Mousawi as the chairman, and members Professor Dr. Yaqzan Sami Mohammed, Assistant Professor Dr. Khudair Jassim Haloub, Assistant Professor Dr. Mohammed Nazim Mohammed Al-Mufarji, Assistant Professor Dr. Adel Abdul Sattar, and Professor Dr. Hameed Jassim Aboud Al-Gharabi as a member and supervisor.
